Payment - All deposits and payments are non-refundable. If a reservation is canceled all payments are nonrefundable with the exception of hazardous weather conditions listed below. Charter deposits and payments may be transferred to future charter dates with a 10% rescheduling fee when rescheduling at least 30 days prior to the originally scheduled departure date. The new rescheduled date must take place within 3 months of the originally scheduled departure date.
Charter modifications other than date of departure may be requested by the charterer if provided more than 48 hours from departure time. Changes such as menu items, substituting a person or itinerary modification may be considered. All charter modifications and changes must be approved by Fathom Wellness LLC charter management.
Termination - Following commencement of the Charter Period, in the event that the Charterer elects to terminate the Charter early, regardless of the reason, the full Charter fees are payable and due immediately.
Hazardous Weather Conditions - Deposits and payments may be reapplied at no additional charge when rescheduling of charter time or date if hazardous weather conditions exist at the time of charter departure. These conditions include storms that have their epicenter passing within 3 miles of Austin, storms that are labeled hazardous and forecast to last more than four hours in duration affecting Austin, Texas and local inland waters.
Non-Cancelable Conditions - Scattered showers, overcast conditions, forecast chance of rain, too much sun, light wind, temperature, waves or chop are not cancelable weather conditions.
Final Authority of the Captain - The captains decision will be the final determination and will be controlling in regard to all weather related conditions and any other conditions regarding the safe operation of the vessel. The Captain has the final decision and authority to require any passenger to disembark who is considered a risk to the other passengers or vessel at any time.
Damages By Client - In the event that the Client or any of it’s passengers shall damage the vessel or its structure, furnishings or equipment the Client shall be responsible for the cost of repair and/or replacement of the damage item(s). This shall not apply to reasonable wear and tear.
